Welcome to MyDream.video, operated by MyDream Labs LLC ("we", "us", "our"). These Terms of Use ("Terms") govern your access to and use of our website, apps, products, and services (the "Service").

1. Eligibility

The Service is for adults only. You must be at least 18 years old to create an account, purchase credits, upload content, or use the Service.

By using the Service, you represent that you are at least 18 years old and legally able to agree to these Terms.

2. Account and Access

You are responsible for your account credentials and for activity under your account. You must provide accurate account information and keep it reasonably up to date.

We may require you to accept updated legal terms before continuing to use the Service.

2A. Regional Availability

As of the date shown with these Terms, the Service is not offered to users located in or accessing the Service from the following countries and regions:

If you are located in one of these countries or regions, we may deny account creation, purchases, uploads, or other access to the Service until launch readiness is complete there.

We have appointed Data Protection Representative Limited (trading as DataRep) as our EEA and UK data protection representative for privacy matters. That appointment does not change the territorial availability restrictions above.

3. Your Content and Allowed Uploads

You retain ownership of photos and other content you upload ("User Content").

By uploading User Content, you grant us a limited, non-exclusive, worldwide license to host, process, store, and use it only as needed to operate, secure, improve, and provide the Service to you, including generating videos you request.

You may upload only your own personal photos where you are the primary identifiable subject and you have all necessary rights and permissions.

Uploading photos of other people is not permitted, including friends, relatives, coworkers, public figures, celebrities, minors, or group photos where other people are identifiable.

4. Acceptable Use

You may not:

violate any law or regulation;
infringe intellectual property, privacy, publicity, or other rights;
upload illegal, abusive, explicit, harmful, or deceptive content;
impersonate another person or misrepresent your identity;
use the Service for harassment, fraud, defamation, or abuse;
reverse engineer, scrape, interfere with, or disrupt the Service.

We may remove content, suspend access, cancel credits, or terminate accounts for violations or legal risk.

5. Entertainment Service Only

The Service is for consumer entertainment and creative visualization only.

It is not medical, financial, legal, employment, safety, or professional advice. You are responsible for how you use generated output and for complying with applicable law.

6. Payments and Credits

The Service offers pay-per-generation credits. There are no subscriptions unless explicitly stated otherwise.

You agree to pay all fees, taxes, and charges associated with your purchases.

6.1 Web Purchases

If you buy credits through our website, we provide pay-per-generation web credits for use with the Service.

6.2 Refunds

Web credit purchases may be cancelled or refunded where required by law.

We may also approve refunds for unused or redeemed web credits in individual cases, including for duplicate charges, fraud, unauthorized transactions, delivery failures, or customer support exceptions.

App Store and Google Play purchases are also subject to the applicable platform's billing and refund rules.

7. Storage and Deletion Timing

Uploaded photos and generated videos are removed from user-facing access and active processing systems within 7 days after upload.

Final deletion from storage layers, replicas, caches, and backups may take additional time because of asynchronous lifecycle processing and provider retention schedules.

8. Generated Output

Output quality and style can vary. Generated videos may contain artifacts, distortions, inconsistencies, or other imperfections.

We do not guarantee that generated output will be flawless, uninterrupted, error-free, or suitable for any specific purpose.

9. Third-Party Services and Platforms

The Service may rely on or link to third-party services, infrastructure, app stores, payment processors, analytics providers, and attribution providers. Their separate terms and policies may also apply.

We are not responsible for third-party products, policies, availability, or acts outside our reasonable control.

10. Copyright Policy (DMCA Notice & Takedown)

We respect the intellectual property rights of others and comply with U.S. copyright law, including the DMCA.

Copyright notices should include the information required by 17 U.S.C. 512(c)(3). Counter-notices should include the information required by 17 U.S.C. 512(g).

When we receive a valid notice, we may remove or disable access to content and take reasonable steps to promptly notify the affected user where appropriate.

We may terminate accounts of repeat copyright infringers where appropriate.

11. Suspension and Termination

We may suspend, limit, or terminate access to the Service at any time for violations of these Terms, legal risk, fraud, abuse, non-payment, security reasons, or platform requirements.

You may stop using the Service at any time. You may also delete your account using the in-app deletion flow or our public delete-account page.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, MyDream Labs LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or revenue.

Our total aggregate liability for claims relating to the Service will not exceed the greater of:

the amount you paid us in the 12 months before the claim arose; or
USD 100.

14. Consumer Rights Carve-Out

Nothing in these Terms limits or excludes any rights that cannot be limited or excluded under applicable consumer protection law.

If you are entitled to mandatory rights under the laws of your place of residence, those rights continue to apply.

15. Dispute Resolution, Governing Law, and Venue

Before filing a claim, both sides agree to attempt informal resolution through [email protected] and allow at least 30 days for resolution.

If informal resolution fails, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association, except where arbitration is prohibited by law or the dispute may be brought in a court that must remain available under applicable consumer law.

Class, collective, representative, and private attorney-general proceedings are waived to the extent permitted by law.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules, except to the extent mandatory consumer protection law requires otherwise.

If arbitration is unavailable for a particular claim, that claim must be brought in a court of competent jurisdiction in Wyoming unless applicable law gives you a non-waivable right to proceed elsewhere.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version and update the legal version/date published with the Service.

17. English Language Version

These Terms are currently published in English only. If we provide a translation, the English version controls to the extent permitted by law.
